The report relates to the management of land holdings by the War Department in the Colony.
Despatch on this subject from the Secretary of State / Duke of Newcastle) dated 27th January 1864, I also attach a copy of the terms under which Inland Lot 14 is held by the Admiralty, and as these differ from the terms used by the War Department, I would suggest that before any further grants are given to the latter, the same procedure should be adopted as has been done with the Admiralty, viz:- a plan of the land should be attached to "Terms of Possession" and registered in the Land Office, where all grants of land should be recorded. Of course, the terms may vary according to the purpose and character of each grant.
In cases of purchase from private individuals out of public funds, the Crown Rent and Rates should cease from the date of purchase; and the property should be sold by the War Department when the land is no longer required for military purposes. The sale of Inland Lot 101 by the Secretary of State for War is a recent case in point.
Several lots in East Point were acquired by the Government for the War Department, and for convenience, these lots were assigned to the Admiralty, the leases being issued in the name of the Secretary of State for War, as seen in CS0439/89, which will be found in the Report from this Office and proposed form of Terms of Possession of the Lots.
